1. Parties
Service provider: Glocsy — Alt-Moabit 77, 10555 Berlin, Germany — support@glocsy.com
Customer: any natural or legal person purchasing services from Glocsy by means of distance communication.
2. Subject Matter
This agreement sets out the rights and obligations of the parties for the remote sale of search engine optimisation (SEO), generative engine optimisation (GEO), technical SEO and content strategy services provided by Glocsy.
The scope, duration, deliverables and price of the service are set out separately in the written quote or project agreement sent to the customer. In the event of a conflict, the specific terms of the quote prevail over this document.
3. Formation of the Contract
The content of the website does not constitute a binding offer. Following your request via the contact form or email, we prepare an individual quote. The contract is concluded when the quote is accepted in writing (including by email).
The contract language is Turkish, English or German. The contract text and quote are sent to you by email and stored by us.
4. Price and Payment
Prices are stated in the quote in euros or in the currency specified there, clearly indicating whether statutory VAT (Umsatzsteuer) is included.
Unless agreed otherwise, payment is made by bank transfer on invoice within 14 days of the invoice date. Monthly services are invoiced at the start of each month.
5. Performance
Services are provided electronically; reports, analyses and content are delivered by email or via shared collaboration tools. The schedule is set out in the quote or project plan.
The customer must provide the information required for performance — such as website access, analytics accounts, content approvals and brand information — in good time. Glocsy is not responsible for delays caused by late provision of such information.
6. Note on Results
Search engine rankings and the answers of AI platforms (Google, ChatGPT, Gemini, Google AI Overview, etc.) depend on algorithms of third parties outside Glocsy's control. Glocsy therefore does not guarantee any specific ranking, traffic level or inclusion in AI answers; it undertakes to provide its services with due care, transparent reporting and in line with current professional standards.
7. Right of Withdrawal (Consumers)
If you conclude the contract as a consumer, you have the right to withdraw from it within 14 days without giving any reason. The withdrawal period starts on the day the contract is concluded.
To exercise your right of withdrawal, simply inform us of your decision by a clear statement (e.g. by email) to support@glocsy.com. It is sufficient to send your notice before the withdrawal period expires.
If you withdraw, we will refund all payments received from you without undue delay and no later than 14 days from the day we receive your notice, using the same means of payment and free of charge.
If you expressly requested that the service begin during the withdrawal period, you will pay a reasonable amount proportionate to the services provided until you notify us of your withdrawal. The right of withdrawal expires once the service has been fully performed, provided you expressly agreed before performance began that you would lose your right of withdrawal.
Model withdrawal notice: "I hereby withdraw from the contract for the provision of the following service: [service], ordered on: [date], name: [name], address: [address], date: [date]."
Customers acting in the course of their trade, business or profession do not have a right of withdrawal.
8. Term and Termination
For services with a fixed term, the term and notice periods are set out in the quote. Unless agreed otherwise, monthly services may be terminated with at least 30 days' written notice to the end of a month.
The right to terminate without notice for good cause remains unaffected.
9. Liability
Glocsy is liable without limitation in accordance with statutory provisions for intent, gross negligence and injury to life, body or health. In cases of slight negligence, Glocsy is only liable for breaches of essential contractual obligations and limited to foreseeable, typical damage.
Glocsy is not liable for consequences of force majeure or of policy or algorithm changes by third-party platforms (search engines, AI providers, hosting services).
10. Governing Law and Dispute Resolution
This agreement is governed by the laws of the Federal Republic of Germany. For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected.
If the customer is a merchant, the courts of Berlin have jurisdiction over disputes arising from this agreement.
Glocsy is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
